Groundbreaking for a significant new mixed-use development at the South Street Seaport took place in 2022. Following the completion of environmental remediation in the previous year, the project gained approval from New York City’s Landmarks Preservation Commission.

However, in July 2022, the South Street Seaport Coalition filed a lawsuit contesting the commission’s approval of the project. In January 2023, the state Court, led by Judge Arthur Engoron, invalidated the commission’s approval. The judge argued that there was an “impermissible quid pro quo” related to the arrangement, wherein the developer, Howard Hughes Corporation, committed to a $40 million payment for air rights associated with Pier 17 and the Tin Building. This funding is intended for the benefit of the nonprofit South Street Seaport Museum.
Ruling Reversal
In June, a panel of appellate judges overturned the earlier ruling, allowing the project to proceed.
